First degree DWI is the most serious and will be charged if the person is previously convicted of a felony, there is criminal vehicular conduct resulting in homicide, or this is at least the third incident of DWI in 10 years. A fourth degree DWI does not carry a minimum jail sentence but can include probation and fines if you are convicted.
